Terms and Conditions for Digital Art Commissions (Canada & International)

These Terms and Conditions (“Terms”) form a binding agreement between [Calcite Crow] (“the Artist”, “I”, “me”, or “my”) and you (“the Client”) regarding the commissioning and purchase of digital artwork.
By commissioning or purchasing digital artwork from me, you confirm that you have read, understood, and agreed to these Terms.
1. Eligibility
You must be 18 years of age or older to purchase or commission artwork from me.
By engaging my services, you confirm that you are legally able to enter into a binding contract under the laws of Canada and your country of residence.
If you are under 18, a parent or legal guardian must provide written consent and handle all communications and payments on your behalf.
2. Services
I create custom digital artwork (commissions) and deliver them in JPG and PNG format only.
No physical products, prints, or editable source files (such as PSD, Procreate, or AI files) will be provided.
All commission details — including subject, style, size (pixel dimensions), and deadline — must be confirmed before work begins.
3. Payment and Currency
A non-refundable deposit of percentage 50% is required before I begin the artwork.
The remaining balance is due upon completion and before delivery of the final files.All prices are listed in Canadian Dollars (CAD) unless otherwise specified.International clients are responsible for any currency conversion fees or transaction charges applied by their bank or payment provider.Payments are accepted via PayPal .For Canadian clients, applicable GST/HST/PST will be added as required by law.4. Delivery
All commissions are digital only and delivered via email or secure download link.
The Client will receive high-resolution JPG and PNG files suitable for personal use.No physical items or printed materials will be shipped.Once the final files are delivered, the Artist is not responsible for file loss, corruption, or download issues.5. Revisions
The Client is entitled to 2 free revisions during the sketch or draft stage.
Additional revisions or major changes after final approval may incur extra fees.Once the final version is approved and delivered, no further changes will be made.6. Cancellations and Refunds
The initial deposit is non-refundable once work begins.
If the Client cancels after partial completion, the Client forfeits the deposit.If the Artist must cancel the commission due to unforeseen circumstances, a full refund will be provided.No refunds are issued after final delivery of the digital files.7. Copyright and Usage Rights (Canadian Law)
Under the Canadian Copyright Act (R.S.C., 1985, c. C-42), the Artist retains full copyright and moral rights to all artwork created.
The Client receives a personal-use license only, which allows them to:Display the artwork online (with credit).Print it for personal, non-commercial use.Commercial use (such as merchandise, logos, resale, or promotional purposes) requires a separate commercial license and written agreement.The Client may not reproduce, modify, resell, or claim authorship of the artwork.The Artist retains the right to display commissioned works in portfolios, online galleries, or promotional materials unless otherwise agreed in writing.8. International Clients
Clients outside of Canada are welcome to commission artwork.
The commission agreement remains subject to Canadian law, regardless of the Client’s country of residence.International clients are responsible for any taxes, duties, or digital import fees imposed by their local jurisdiction.Communication and delivery will be conducted in English, and all invoices will be issued in Canadian Dollars (CAD).9. Credits
When sharing or posting the artwork online, the Client must credit the Artist as follows:
“Artwork by [Calcite Crow]”
or tag @calcitecrow on social media.
10. Confidentiality
All private correspondence, project details, and reference images provided by the Client will be kept confidential and used solely for completing the commission.
11. Limitation of Liability
The Artist is not liable for any losses, damages, or claims resulting from the Client’s use or misuse of the artwork or digital files.
All artwork is provided “as-is” without any warranties.
The Artist is not responsible for file corruption, data loss, or software compatibility issues after delivery.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of Canada and the Province of Prince Edward Island.
Any disputes shall be resolved exclusively in the courts of Prince Edward Island, Canada.
13. Acceptance of Terms
By commissioning or purchasing artwork from me, the Client confirms that:
They are 18 years of age or older, or have parental/guardian consent.
They have read and agreed to these Terms and Conditions.They understand that the commission is digital-only, and they will receive JPG and PNG files via electronic delivery.Contact
